Similar to how YouTube gets away with a ton of copyright infringement, this is just going to be a form of regulatory capture. The early well funded players get to keep using pirated material for their models, but if you or anyone else trains a model the same way, you’re going to face legal penalities.
This has always been the issue with AI training in general. We’re just hitting a point where it’s more out in the open.

Well what would happen if anyone else plagiarized copyrighted works? I’ve seen people get locked away for piracy even. Remember what became of Aaron Swartz? Why the fuck should these people get special treatment now?

Pay for every piece of anything you use. Even training on past works ain’t cool to me. Most people didn’t write stuff in order to put people out of work. Every damn thing needs consent and they should pay for it.

Training is transformative.
The robot does not contain the work. The robot has seen the work enough times to extract the essence of Shrek, to where it can almost draw his outfit right. How else were you gonna get a chatbot that knows what things are? You can’t derive Lord Of The Rings from first principles. Either it learned from the library book, or it learned from some blog posts describing the library book.
I don’t even care about normal piracy, and I’m supposed to be mad about linear algebra that can inaccurately describe pop culture? Like an SSD-filling model is a substitute for a 100 KB text file?
