A federal court said Thursday that it will allow a US House election in South Carolina for Republican Rep.Ā Nancy Maceās seat to proceed under a map it hadĀ previously declared unconstitutional.
In a brief order, the judges in the case said they had little choice, given a fast-approaching deadline to prepare for the primary election for the stateās down-ballot contests.
Last year, the three-judge panel held that the stateās GOP-controlled Legislature had āexiledā more than 30,000 Black residents from the coastal 1stĀ Congressional District, which is anchored in Charleston County, in what the court called a ābleachingā to benefit Republicans. That amounted to an unconstitutional racial gerrymander, the judges concluded.
I donāt think thatās legal. Taxation without representation and whatnot
But the current status is not representation either.
You could make the argument, but literally they have the right to elect someone. There is no legal right to not be gerrymandered, per SCOTUS
If weāre being technical, thereās no legal right to no taxation without representation either.
Meanwhile Washington DC exists.
They have no senate representation because they arenāt a state. They have a house seat
